Minnesota DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Minnesota DUI penalties:
First Offense
- a fine of no more than $3,000.00
- possible term of imprisonment of no more than 1 year
- participate in a self help class
Second Offense
- a fine of no more than $3,000.00
- possible term of imprisonment of no more than 1 year
- court ordered evaluation from a qualified counselor or psychologist
- monitored electronically
Third Offense
- vehicle seizure
- 90 days of incarceration, at least 30 days of which must be served consecutively in a local correctional facility
- court ordered evaluation from a qualified counselor or psychologist
- a fine of no more than $10,000.00
