Georgia DUI Law - Information


You can be arrested for DUI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Georgia DUI penalties:

First Offense

  • a fine of no more than $1,000.00
  • mandatory 40 hours of community service
  • possible term of imprisonment of no more than 12 months
  • impoundment of vehicle for 10 days
  • license suspension for 1 year

Second Offense

  • a fine of no more than $1,000.00
  • mandatory 30 hours of community service
  • possible term of imprisonment of no more than 12 months
  • license suspension for 3 years
  • license plate confiscation for 3 years
  • photograph, name and address, as well as the date, time, place of arrest will be published in your local newspaper. You will be charged $25.00 for this notice

Third Offense

  • a fine of no more than $5,000.00
  • mandatory 30 hours of community service
  • possible term of imprisonment of no more than 12 months
  • license suspension for 5 years
  • complete DUI school
  • must be evaluated by an alcohol assessment and treatment facility, and complete all treatment recommendations before you can get your ignition interlock permit
  • mandatory ignition interlock device installed in your car for 6 months
  • license plate confiscation for 5 years
  • photograph, name and address, as well as the date, time, place of arrest will be published in your local newspaper. You will be charged $25.00 for this notice
