Georgia DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Georgia DUI penalties:
First Offense
- a fine of no more than $1,000.00
- mandatory 40 hours of community service
- possible term of imprisonment of no more than 12 months
- impoundment of vehicle for 10 days
- license suspension for 1 year
Second Offense
- a fine of no more than $1,000.00
- mandatory 30 hours of community service
- possible term of imprisonment of no more than 12 months
- license suspension for 3 years
- license plate confiscation for 3 years
- photograph, name and address, as well as the date, time, place of arrest will be published in your local newspaper. You will be charged $25.00 for this notice
Third Offense
- a fine of no more than $5,000.00
- mandatory 30 hours of community service
- possible term of imprisonment of no more than 12 months
- license suspension for 5 years
- complete DUI school
- must be evaluated by an alcohol assessment and treatment facility, and complete all treatment recommendations before you can get your ignition interlock permit
- mandatory ignition interlock device installed in your car for 6 months
- license plate confiscation for 5 years
- photograph, name and address, as well as the date, time, place of arrest will be published in your local newspaper. You will be charged $25.00 for this notice
