Illinois DUI Law - Information
You can be arrested for DUI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
Illinois DUI penalties:
First Offense
- a fine of no more than $500.00
- mandatory 50 hours of community service
- possible term of imprisonment of no more than 6 months
- impoundment of vehicle for 10 days
- license suspension for 180 days
- attend a DUI School
Second Offense
- a fine of no more than $1,000.00
- possible term of imprisonment of no more than 9 months
- impoundment of vehicle for 30 days
- license suspension for no more than 5 years
- attend a DUI School
Third Offense
- a fine of no more than $5,000.00
- possible term of imprisonment of no more than 12 months
- impoundment of vehicle for 90 days
- 2 year drinking driver program
- license suspension for no more than 10 years
- attend a DUI School
