Florida DUI Law - Information


You can be arrested for DUI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Florida DUI penalties:

First Offense

  • a fine of no more than $500.00
  • mandatory 50 hours of community service
  • possible term of imprisonment of no more than 6 months
  • impoundment of vehicle for 10 days
  • license suspension for 180 days
  • attend a DUI School

Second Offense

  • a fine of no more than $1,000.00
  • possible term of imprisonment of no more than 9 months
  • impoundment of vehicle for 30 days
  • license suspension for no more than 5 years
  • attend a DUI School

Third Offense

  • a fine of no more than $5,000.00
  • possible term of imprisonment of no more than 12 months
  • impoundment of vehicle for 90 days
  • 2 year drinking driver program
  • license suspension for no more than 10 years
  • attend a DUI School
