Missouri DWI Law - Information


You can be arrested for DWI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Missouri DWI penalties:

First Offense

  • a fine of no more than $500.00
  • possible term of imprisonment of no more than 6 months

Second Offense

  • a fine of no more than $1,000.00
  • possible term of imprisonment of no more than 5 years
  • participate in 30 days community service
  • mandatory ignition interlock on the driver's car for no less than 1 month

Third Offense

  • felony charge
  • a fine of no more than $5,000.00
  • recieve a felony charge
  • possible term of imprisonment of no more than 5 years
  • participate in 60 days community service
