Minnesota DWI Law - Information


You can be arrested for DWI when:

A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.

Minnesota DWI penalties:

First Offense

  • a fine of no more than $3,000.00
  • possible term of imprisonment of no more than 1 year
  • participate in a self help class

Second Offense

  • a fine of no more than $3,000.00
  • possible term of imprisonment of no more than 1 year
  • court ordered evaluation from a qualified counselor or psychologist
  • monitored electronically

Third Offense

  • vehicle seizure
  • 90 days of incarceration, at least 30 days of which must be served consecutively in a local correctional facility
  • court ordered evaluation from a qualified counselor or psychologist
  • a fine of no more than $10,000.00
