New York DWI Law - Information
You can be arrested for DWI when:
A person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant's blood.
New York DWI penalties:
First Offense
- a fine of not less than $500 nor more than $1,000.00
- possible term of imprisonment of not more than 1 year
- forfeit your right to operate a motor vehicle over the highways of New York for a period of six months
Second Offense
- a fine of not less than $1,000.00 - $5,000.00
- possible term of imprisonment of not more than 4 years
- forfeit your right to operate a motor vehicle over the highways of New York for a period of 1 year
Third Offense
- a fine of $2,000.00 - $10,000.00
- possible term of imprisonment of not more than 7 years
- forfeit your right to operate a motor vehicle over the highways of New York for a period of 1 year
