Yamaha Rhino Rollover Injury Lawyer

Yamaha Rhino All Terrain Vehicle (ATV) Rollover

Hundreds of rollovers, no recall.

Yamaha Rhino ATV rollover accidents have injured and killed hundreds of children and adults.  The Rhino ATV is a very popular product sold by transportation giant Yamaha Corporation.  The Yamaha Rhino has a high center of gravity and narrow wheel base which creates an unreasonable risk of rollover, even on flat surfaces. This is a particularly troubling fact in light of the fact that the Rhino is marketed as a vehicle appropriate for operation on hills, mountains, mud and other off-road surfaces.

Many people have been injured in Rhino ATV accidents, sustaining crushed limbs, brain injuries, broken bones and other serious and permanent injuries. Some statistics state that as many as 75% of rollover accidents result in serious injury to the head or spinal cord. According to the Consumer Products Safety Commission, ATV driving leads to more than 700 deaths and more than 135,000 injuries annually in America, and about 30 per cent of those involve children. Texas is among the top five states for ATV deaths, along with Pennsylvania, California, West Virginia and Kentucky.

What has Yamaha done in response to these injuries?  Answer: Continue to market and sell the Yamaha Rhino ATV.

In September 2006, Yamaha Motor Corp. sent a letter to the owners of Rhino ATVs warning that the Rhino ATV was prone to rollover while going through sharp turns. Incredibly, the wording of the Yamaha letter placed much of the blame for Rhino rollover accident injuries on the victims themselves. Yamaha warned passengers of the Rhino ATVs to use seatbelts, and to keep their hands, arms and legs inside the vehicle at all times. The letter also included information on handling the Rhino if it should start to tip over. The actions recommended by Yamaha do little to protect passengers involved in Rhino rollover accidents.

In 2007, in response to an increasing number of serous injuries, Yamaha offered free modifications to the owners of new and used Rhinos. These modifications included the addition of doors to the ATV, as well as additional handholds. However, the company still has not recalled or offered refunds to the owners of the dangerous Rhino ATVs.

We believe that people purchase ATVs with the intent to use them safely and trust that they are reasonably safe for the intended purpose. Unfortunately, for many people, it is apparent that Rhino ATVs are dangerous even under normal operating conditions. It is our mission to represent people injured as a result of Rhino ATV accidents. We have the knowledge, experience and resources to go the distance for our clients.
