Social Security Disability (SSD):
If you are unable to work for a period of 12 months or more, you may be eligible for Social Security disability (SSD) benefits. You must have worked 20 of the 40 quarters before you became unable to work. If you have not built up enough quarters, then you may qualify for Supplemental Security Income (SSI) benefits. You may apply online at http://www.socialsecurity.gov/applyfordisability.
You may also go to your local Social Security office and apply in person. You should be prepared to furnish the names, addresses, and dates of service for all recent medical history, and to describe your work history for the past 15 years.
Social Security will then gather your information and forward it to the Disability Determination Services (DDS), who will then decide whether you meet Social Security criteria.
If your claim is denied, you have 60 days to appeal that denial. You should then contact your attorney immediately. If your claim is denied again, you should make sure your attorney has a copy of the notice, because an appeal of that denial must be filed within 60 days of that second denial.
As a skilled Portland Social Security Disability Workers' Compensation Attorney, I will request a hearing on your behalf before an administrative law judge (ALJ), and it will be 18 to 24 months before a hearing is held. Under some unusual circumstances, I am able to obtain a decision on the record earlier than two years, but you should be prepared for a long wait.
Supplemental Security Income (SSI):
If you are unable to work, but you have worked less than 20 of the past 40 quarters, you may be eligible for SSI. You may own your own home, and a vehicle that you use for personal transportation, but generally you may not have more than $2,000 ($3,000 for a married couple) in liquid resources to qualify.
Workers' Compensation:
Oregon workers’ compensation is a very complicated system that administers benefits to workers who have been injured on the job. Many problems can arise in the course of a workers’ compensation claim.
What is workers' compensation?
Your employer has purchased insurance to cover your medical costs and lost wages if you are injured on the job. You should file a claim with your employer as soon as possible. Except under very limited circumstances you cannot sue your employer; your claim is for medical care, lost wages, and other benefits against your employer’s insurer.
What is covered by workers' compensation?
Medical care:
- You have the right to be treated by a doctor of your choice. It is very important that you select a physician that you trust is acting in your interests, and not in the interests of the insurance company.
- You are entitled to have your medical expenses covered related to your on the job injury, including mileage to doctor’s appointments and reimbursement for out of pocket expenses, such as prescription medications.
- If you miss more than three days of work because of your injury the insurer must pay you for time loss. Your time loss is paid at the rate of 2/3 of your average weekly wage, and must be paid within 14 days of your first day of lost time, and every 14 days after that.
- If your employer offers you light duty work within your restrictions, the insurer will reduce your compensation payments based on the wages your employer is paying you.
- Your doctor must approve the job that has been offered you. If you have doubts about whether you are physically able to do that job, talk that over with your doctor at once. If you don’t work the hours offered to you, your insurance company will reduce your compensation anyway.
There is no compensation in a workers’ compensation claim for pain and suffering. If you have suffered permanent impairment as a result of your injury, you will receive an award based on rules established by the State of Oregon Workers’ Compensation Division.
Vocational rehabilitation:
If you are unable to do the kind of work you were doing before you were injured, in many instances cases you will be eligible for retraining, paid for by the insurance company.
Hearing loss:
I see many workers who are, later in life, suffering the effects of a lifetime's exposure to industrial or work-related noise. If you suffer from hearing loss, this may be related to your work, and you may be eligible for compensation for this injuiry.

Practice Areas and Legal Definitions
Social Security Disability (SSD):
Social Security provides disability insurance benefits to those who have worked and paid Social Security taxes and have become disabled. In order to receive benefits, the claimant must establish 1) that the disabling condition makes it impossible to perform any substantial work, and 2) that the disability is expected to last at least a year or until death.
Supplemental Security Income (SSI):
Social Security provides SSI benefits for those who are severely disabled but not eligible to receive Social Security disability insurance benefits. This is usually because the claimant did not work long enough in Social Security covered employment to establish eligibility. SSI differs substantially from Social Security disability. The benefits are lower, there is no provision for dependent or survivors benefits, and the disabled person cannot own substantial assets or have substantial income from any source.
Cessation:
Cessation involves the involuntary termination of Social Security disability or SSI benefits. This is usually based on a determination that the disabling condition does not exist or no longer exists and/or, in the case of SSI, that the disabled person’s income and/or assets are too substantial to warrant benefits.
Workers' Compensation:
Workers' compensation is insurance that an employer is required by law to carry in case an employee is injured on-the-job or becomes ill, temporarily or permanently disabled, or fatally injured due to circumstances surrounding his or her job.
Although workers' compensation laws vary from state to state, covered medical care generally includes medical, surgical and hospital services, dental services, crutches, hearing aids, chiropractic treatment, physical therapy, nursing care and prescribed medications. Additional monetary compensation may be provided if an injured employee is temporarily unable to work for more than a certain number of calendar days set by state law, hospitalized as an in-patient, or becomes permanently disabled due to a job-related injury or illness. The right to receive medical treatment at the employer's expense typically continues as long as treatment is reasonable and necessary to treat the injury.
Orthopedic injuries:
Orthopedic injuries can include injuries involving the spine, bones, joints, muscles, nerves and other parts of the skeletal system. The most common orthopedic injuries are bone fractures, sprains and strains. Sprains describe an injury to a ligament and strains describe an injury to muscle. Treatment for orthopedic injuries include medical counseling, medications, casts, splints and therapies, such as exercise or surgery.
Repetitive trauma injury:
If an individual develops a repetitive trauma injury (i.e. carpal tunnel syndrome, tendonitis, tennis elbow, etc.) from duties performed while on-the-job, he or she may receive workers' compensation benefits including their choice of doctor(s), full medical care compensation, lost wage benefits, a lump-sum cash settlement, vocational retraining or re-schooling and permanent wage loss benefits.
Construction/Industrial Accidents:
Construction labor makes up one of the three most dangerous occupations in the United States today; each year producing thousands of debilitating injuries and wrongful deaths. Factors that contribute to construction accidents include workers lifting loads with worn and weathered cables, working on elevated platforms without fall protection or wearing defective safety harnesses and lanyards, and/or working in trenches with improper benching and using outdated tools and equipment.

Retaliatory Discharge:
If an individual is terminated from their place of employment after reporting a workers' compensation claim, he or she could be entitled to substantial damages in a retaliatory discharge lawsuit against their former employer.
Federal laws prohibit an employer from discharging or discriminating against an employee because of a workers' compensation injury. If an employer fires or forces the resignation of an injured employee in retaliation for filing a workers' compensation claim, the employee can file a civil lawsuit against the employer seeking damages in court, provided the employee has evidence of such an allegation. Also, if an employer denies permission for immediate medical attention following a work-related injury, or does not permit an employee to seek out the services of other medical professionals in conjunction with assigned company doctors, the employee can seek legal retribution under workers' compensation laws.
