Although employment is presumed “at-will” in California, California law protects employees from discharge or forced resignation for attempting to protect a lawful right or other reasons not permitted by law. WAGE AND HOUR DISPUTES
The Fair Labor Standards Act (FLSA) provides employees certain rights to ensure they are not overworked or underpaid. Specific rules have been enacted to enforce employees’ overtime rights, meal breaks, rest breaks, working conditions, payroll information, hiring and firing (also see discrimination). California is currently undergoing major litigation concerning overtime complaints. Please give the MLG a call if you feel you have not been paid promptly and appropriately.
UNFAIR TRADE PRACTICES
California currently has a four (4) year statute of limitations for acts appropriated by means of unfair trade practices. California law is concerned with the competitive advantage some companies may gain over others by unlawful means. This may include rights granted to employees under the wage and hour laws.
