More than fifteen years ago, we made the choice to concentrate our practice on the area of medical malpractice. We focus in medical negligence work. Partner Stanley J. Heller, M.D., J.D., is both a doctor and a lawyer. Board certified in Internal Medicine and Cardiology, he received his medical degree from the world-renowned Johns Hopkins School of Medicine. We have only one practice area: medical malpractice. We have chosen to concentrate in this one area of law so that we can serve you better in that area. But you may not be sure whether your case is a medical malpractice case. So let’s start with a discussion of what is Medical Malpractice.
 
What is Medical Malpractice?
 
Everyone has the right to get good, competent medical care. When a doctor, nurse
pharmacist, hospital or other medical care provider makes an error that causes injury
they can be held accountable for what the law calls “medical malpractice.” It is sometimes called medical negligence. They mean the same thing.
 
It would be impossible to list all the ways in which medical malpractice can occur, but
some examples include: making mistakes when delivering babies (not taking them out when they get in trouble, for example), giving too much (or too little) medication, missing a diagnosis, not recognizing the seriousness of a patient’s condition, letting an infection get out of control, failing to timely diagnose cancer or brain injuries, or even something as mundane as failing to maintain equipment used in surgery or during a hospital stay.
 
In most states, in order to file a medical malpractice claim, we must first have the case reviewed by an expert witness, usually a physician, who certifies that there was negligence or malpractice. Once we get the certification, we are allowed to file the law suit. To win the law suit we must prove:
 
            1.         that the defendant doctor made a mistake. This is called negligence. It
basically means that the doctor did something (or failed to do something) that
reasonable doctors wouldn’t do (or would do), and
 
            2.         that because of the doctor’s mistake, the patient was injured.
 
To prove these things, the law in most states (if not all) require the testimony of an
expert doctor, and some cases, multiple expert doctors.   These experts are required to
testify not only that an mistake was made, but also that the mistake caused (or was a
significant cause of) the injury.
 
Finding another doctor to testify against a fellow physician is typically costly and
difficult.   One advantage our firm has is that, because of our experience in the medical field, we have access to a wide range of highly qualified experts in almost all specialties.
 
Insurance companies that defend malpractice claims are either owned by medical societies or reliant on them for their business. Physicians rarely view a medical malpractice claim against them as legitimate and can prevent their insurer from settling the case without their approval. Physicians usually insist (and the insurance companies comply) that they be aggressively defended regardless of the cost and, often, regardless of the merits of the case. The insurance companies then invest large amounts of capital and time into defending these claims. This practice overwhelms and intimidates inexperienced law firms.
