Bankruptcy Laws:
Bankruptcy is a federal court process designed to help individuals and businesses eliminate their debts or repay them under the protection of the bankruptcy court. Bankruptcies can generally be described as liquidation (Chapter 7) or reorganization (Chapter 13).
Chapter 7:
Chapter 7 cases are commonly referred to as straight bankruptcy or liquidation cases, and may be filed by an individual, corporation, or a partnership. In a Chapter 7 bankruptcy, the debtor is allowed to keep certain exempt personal and real property (e.g., homestead property), while the bankruptcy trustee sells the debtor’s non-exempt property and distributes the proceeds to the creditors. A debtor must qualify to file a Chapter 7 bankruptcy based on household income. At the conclusion of a Chapter 7 bankruptcy case, the debtor’s qualifying unsecured debts are discharged and the debtor is absolved from further liability on most debts.
A Chapter 7 bankruptcy can be used to stop wage or bank account garnishment, discharge medical and credit card debt and stop collection efforts. A Chapter 7 bankruptcy can also be used to temporarily stop a foreclosure action, however, a foreclosure action cannot be resolved through a Chapter 7 bankruptcy; mortgage arrears and assessments can only be cured through a Chapter 13 bankruptcy.
Chapter 13:
A Chapter 13 bankruptcy is also called a wage earner's plan because the debtor must have income to make monthly payments under a “plan”. In a Chapter 13 bankruptcy, debts are no longer immediately due and, instead, may be paid back through the plan in smaller monthly payments over a period of 3 to 5 years. As in a Chapter 7 bankruptcy, upon completion of payments under the plan, the debtor’s qualifying unsecured debts are discharged, and the debtor is absolved from further liability on most debts.
A Chapter 13 bankruptcy is an excellent tool with which to stop a foreclosure action and to bring the mortgage or assessments current by paying the arrears over a 3 to 5 year period. A debtor may choose to file a Chapter 13 bankruptcy instead of a Chapter 7 bankruptcy in order to keep non-exempt property that would be sold by the trustee in a Chapter 7 bankruptcy by paying creditors the value of the non-exempt property through the plan over a 3 to 5 year period. A Chapter 13 bankruptcy can also be used to stop wage or bank account garnishment, discharge medical and credit card debt and stop collection efforts.
