Myth #1

"I don't need a lawyer because the real estate broker or mortgage lender will look out for my interests."

Reality

The real estate broker and lender are not typically compensated if the transaction does not close. Consequently, it is unlikely that they can or will call attention to potential problems that could jeopardize their commissions. Furthermore, non-attorneys are not trained or experienced in the myriad of legal issues surrounding the conveyance of real property.

Myth #2

"Any lawyer can do a home closing."

Reality

Although technically accurate, this statement is difficult to reconcile with the fact that real estate practice is one of the highest categories of lawyer malpractice claims by consumers. It is wise to have an attorney experienced in real estate matters.
