Creditors Rights
Creditors rights are the rights that creditors have, generally based on a contract or other written agreement, to attempt to collect a debt from another person. Since most creditors rights language in contracts is drafted heavily in favor of the creditors, some courts will strike some of the creditors rights provisions in contracts when cases go to court. However, in most cases rights are protected and creditors are allowed, within the bounds of the law, to attempt to collect and negotiate a debt directly. Sometimes these rights are cancelled when a person declares bankruptcy. However, depending on the type of bankruptcy protection a person seeks to gain, some creditors’ rights may be preserved and the debtor may still have to pay some of the money owed.
