Post-Sentencing Lawyers

Post-sentencing motions are filed by the lawyers who try a criminal case. Generally, the defendant’s lawyer files motions to appeal or motions regarding the terms of the sentence itself to an appellate court. The prosecution files post-sentencing motions to argue against the motions filed by defense counsel. It is standard practice to file a series of motions that are routinely rejected by the trial court. The reason for filing these motions is to specifically preserve certain arguments for a later appeal.
