FMLA Form Lawyers

The FMLA form is the notice that must be filed by an employee with his or her employer requesting leave. The law requires that when at all possible the employee provide 30 days notice to the employee of the intention to take a leave of absence. The FMLA form would be available from the employer and should not be unreasonably withheld. It can also be obtained from the Department of Labor. The law provides for leave of up to 12 weeks in any 12 month period for “eligible” employees. Eligibility generally depends on the time the employee has been with the company or the number of hours worked in the prior twelve months. The law requires that at least 1,250 hours have been worked during that time.
