Arbitration is a form of alternative dispute resolution. While the other prominent form of dispute resolution, mediation, is also popular, the key difference is that in an arbitration the decision of the neutral professional is binding on the parties in the same way that a court decision would be. This means the decision can be enforced by law. The process can be more formal than in a mediation, but is still often completed far more quickly than a formal judicial trial. In addition, the process has more privacy, as opposed to a judicial process in which all records are somewhat public.
