Arbitration mediation is somewhat of a misnomer. The key distinction between the two is that in the former the decision by the neutral is binding on the parties as would a court decision be, whereas in the latter the decision is not binding. The term arbitration mediation arises because both are key forms of alternative dispute resolution and many professionals, including lawyers, provide both services.
