Litigation is the process by which a person brings a claim for damages to court or defends against litigation started by another party. Civil litigation relates to the entire process of filing a lawsuit, discovery and motion practice, trials, judgments and awards of damages. The law related to the civil litigation system also pertains to appeals from civil litigation cases. Criminal litigation refers to the similar process by which a criminal trial takes place. Many lawyers practice in the civil and criminal litigation practice area, filing and defending suits. Without a skilled litigation lawyer, it is very difficult to win a case. In criminal cases, most states provide legal counsel to defendants who cannot afford a lawyer. In the civil litigation process most states do not provide counsel to parties who cannot afford lawyers.
