Debt collection is a process in which a creditor attempts to directly or indirectly collect a debt from another person or business. Creditors can attempt to collect a debt directly by contacting the debtor’s employer to make arrangements to pay the debt. When debt collection is undertaken indirectly, it means the creditor has hired an agency or law firm to collect the debt. In either instance, debt collection is governed by the federal Fair Debt Collection Practices Act and many state laws that protect debtors from certain forms of harassment during the process. Agencies or businesses who violate the law are subject to fines that in some cases can exceed the total amount of the debt sought to be collected.
