Appeal is the formal procedure by which a person disputes the decision of a trial court or governmental agency. Typically, the process must be based on either a substantive or procedural error in the trial. In many cases, the appeal is based on a claim that evidence was improperly secured or improperly used in court. Other times, it relates to rulings made by the trial court, the instructions given to the jury or other procedural rulings. However, in many cases it is grounded in the presence of new evidence that a person feels should be considered by the court.
