Search and seizure law relates to protections against government intrusion. The rights are protected by our Constitution. Most search and seizure law cases arise because the government has secured evidence and the defendant seeks to keep that evidence from being used in court. Such cases often involve interpretation of the Constitution to particular fact situations, such as the entry into a car, apartment or home to secure evidence of a crime.
