Debtors Rights
Debtors’ rights are generally a matter of public policy that can be enforced by courts or that exist as statutory protections. Debtors’ rights are protected, for example, by some courts when a debt collection matter goes to court and the relative bargaining power of the parties is far from even. Debtors’ rights are also protected by the bankruptcy laws. Also, debtors’ rights are protected by the federal Fair Debt Collection Practices Act and many similar state laws. Generally, debtors rights include the right to be free from heavy-handed or threatening collection practices; the right to know the amount, terms and original creditor that is the subject of a collection; the right to a hearing prior to a judgment being imposed around a debt owed; and the right to make a good faith effort to resolve the debt.
